How Can I Stop My Creditors from Contacting Me?

One of the most frequently asked questions is “when will my creditors stop calling me?” The answer to that question is once your bankruptcy case has been filed. Once the bankruptcy case has been filed the United States Bankruptcy Court issues an Order called the “automatic stay” order. This happens simultaneously with the filing of your case.

Your bankruptcy case filing will include a creditor Matrix, which is a list of the names and addresses of all creditors, collection companies and attorneys who have been, or who are, involved in the collection of your debts. If any of these parties continue to engage in actions to collect a debt after your case is filed, then they can be found in contempt of the automatic stay order. A party who violates the automatic stay order can be required to pay the attorney fees and costs you incurred to enforce the automatic stay order, plus compensatory and punitive damages in some cases.
